OUT OF COURT
SETTLEMENT







 
      
 
          On October 26 & 27, 2006 I forwarded my out of court settlement to the parties involved in the financing and distribution of Donnie Darko, Donnie Darko The Director's Cut and SouthLand Tales.  I contacted the attorney from California to deliver it but after finding out what was involved he refused to represent me.  Below is a reprint from FedEx confirming the delivery to NewMarket Entertainment Group, Creative Artists Agency, Cherry Road Films, Inferno Distribution and Persistent Entertainment.  























































          Only two of the four parties involved in
"Donnie Darko" that I sent my Message to CHOSE to accept it.  They were Newmarket and Richard Kelly’s agent, Mr. John Campisi at C.A.A. (Creative Artists Agency).  The staff at Creative Artists Agency returned the Message to me with a letter dated October 30, 2006 which I have reprinted below.  Please be kind enough to read that letter as it is another page in this "real" book and another scene in this "real" film. 

























































          This letter epitomizes this entire affair!  My Message was returned to me in a different order than I sent it to C.A.A. in.  Some pages were duplicated while others were out of order.  For not accepting submissions someone went through a lot of trouble to make copies of my Message.  In addition there is a line stating:



   
       "Your unsolicited submission has not been, and will not be disclosed to any executive or other employee of Creative Artists Agency or any other person.  You should be aware that many ideas are generated by our employees and our clients or other sources.  To the extent that any projects are generated which contain elements similar to what you submitted, the similarities are purely coincidental."



          Somehow the words
"purely" and "coincidental" don’t go together in the context of that paragraph which proves my copyright infringement case to the point.  Whether Literary Agencies or "talent" agencies, the dogma is the same!  Take what you can get your hands on and claim it as your own with no regard for the original creator and author!  My out of court settlement will remind you of several popular TV and cable shows.  See if you can guess which "similar elements" to those "submitted" in my out of court settlement dated October 26, 2006 were turned into those popular TV and cable shows that have appeared since then.  Some of them are obvious and others less so.  Therein lies the source of

          The representative for Ms. Drew Barrymore's Flower Films initially accepted my Message but then paid FedEx to send it back to me.  Below is a copy of the FedEx envelope dated November 3, 2006 with my Message double sealed inside of the original FedEx envelope that I forwarded on October 26, 2006. 

































          Gaylord Entertainment initially accepted my Message, then told FedEx the package didn’t belong there and to come back and pick it up.  FedEx picked up the Message from Gaylord Entertainment and telephoned me to ask if I wanted it returned to me.  I said "yes" and paid FedEx to return it to me, unopened and in its original sealed and dated FedEx envelope of October 26, 2006, with the original tracking number, double sealed inside of another FedEx envelope dated November 3, 2006 with a new FedEx tracking number.  Below is a copy of the FedEx envelope.

































          Quite conversely to the
"Donnie Darko" recipiants, the three parties involved in the financing of "SouthLand Tales" who I sent my Message to accepted it because they have seventeen million dollars invested in the film.  Needless to say no one involved in the financing and creation of either "Donnie Darko" or "SouthLand Tales" responded to my Message in the spirited way I'd hoped they would.  They did respond to it by REACTING to it but they did not respond to me personally.  The only reason you are reading the material on this website is because they are trying to keep you ignorant of what this is all about.  I wasn’t offended when two films were made about my life, my near death experience, my rebirth, and the deaths of some of my closest friends - In fact I was humbled beyond words.  I wasn’t offended when I found out how successful "Donnie Darko" was and how much money it made - I was thrilled.  I was very offended, however, when I introduced myself in a very constructive, and LOVING way to discuss something of PROFOUND IMPORTANCE TO THE WORLD and was ignored.  I realize that none of them knew the high road otherwise they would have joined me for a stroll.  If everyone who received my Message believed that I was going to disappear into thin air then they were sadly mistaken.  They adopted the BEAST (Frank) created, BEAST (Frank) sanctified DELUSION that



IF YOU DON’T LIKE THE MESSAGE

                                                        …………   YOU DESTROY THE MESSENGER.


Or at least you ignore him.


 
          I almost died three times to get to this point and NOTHING, and NO ONE will stop me and I will not permit ANYONE, or ANYTHING, to get in the way of completing my TASK.  I CANNOT, and I WILL NOT be ignored - this is MUCH GRANDER than everyone involved in "Donnie Darko" and "SouthLand Tales."  All of the wonderful creativity and the "MIRACLE" that could have manifested with those who CHOOSE not to accept my Message was lost to FEAR as they gave into the FEAR of their own Villain and became "Frank."  Kevin Thomas, of calendarlive.com, ends his review of "Donnie Darko" by saying:



          "Donnie Darko is as amusing as it is provocative.  At heart its message is clear enough - an exhortation to keep an open mind, to EMBRACE EACH OTHER and the universe with its SEEMINGLY INFINITE POSSIBILITIES, come what may.  The great thing is that ‘Donnie Darko’ with its cosmically comic perspective, makes these endeavors so exhilarating." 



          I tried to get everyone involved
to keep an open mind and to EMBRACE EACH OTHER but in the end "Frank" won out!  All of those SEEMINGLY INFINITE POSSIBILITIES were lost to FEAR!  NO ONE INVOLVED IN THE CREATION OF "Donnie Darko" understood their own film.  They spent four and a half million dollars on an incredible journey and none of them got it.  To read the contents of my out of court settlement . . .
